AGREEMENT TO TERMS

These Terms and Conditions represent a legally binding agreement made between you, whether on behalf of an entity or personally ("you") and CampTeam Games ("we", "us", "our"), regarding how you access and use our game: The Callous Waterbuck Wall (the "Application"). CampTeam Games refers to the development team for the Application and as of the date of these Terms and Conditions it is fully represented by Hasan Said Yeni. You agree that by accessing / downloading the Application, you have read and understood these Terms and Conditions and agreed that all of the following Terms and Conditions are legally binding for you. It is essential that you carefully read through this agreement, as it is important.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOUR USE OF THE APPLICATION IS EXPRESSLY PROHIBITED AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We have the right to modify or make changes to these Terms and Conditions at any time at our discretion. We will alert you about any changes or modifications by updating the "Last Updated" date of the Terms and Conditions post on our official game page(s).

As of the date of these Terms and Conditions, this post can also be accessed from the official itch.io page of the Application. It is your responsibility to review our official itch.io page to stay informed of these updates. You will be subject to, and will be deemed to have informed yourself of, to have agreed and to have accepted the changes in any updated Terms and Conditions by your continued use of the Application after the date these updates are posted on our official game page(s).

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise specified, the Application is our property and all 3D models, defining story elements, 3D renders, digital artwork, sound effects and other audio, that were created by us and used in the Application (collectively, the "Content") are owned and / or licensed to us, and are protected by copyright laws and various other intellectual property rights.

Certain aspects of the Application may incorporate randomly generated names for locations. Should any of these names resemble real-life places, it is purely coincidental. This also holds true for any characters, their names, items, or narrative elements within the Application.

To specify, as of the date of these Terms and Conditions, the Application version V.1.2.7 uses text-to-voice services for the creation of voiceovers for game characters. In order to create these voiceovers we have used a service that is called Replica Studios. The Terms of Service for Replica Studios grants us a perpetual, worldwide licence to use these synthesized voiceovers for any purpose in compliance to their terms of use.

The Application is created using the open source game engine Godot Engine and we aim to comply with its Terms and Conditions. This paragraph is a direct indication that we do not claim to control, claim to be the creator of or claim to be the owner of the licenses to Godot Engine, the Godot Engine binary or any of its related third-party components. Godot Engine has its respective copyright notice and license statement and as of the date of these Terms and Conditions, sees the following link to their page to be an acceptable way to satisfy the license terms:

The Application uses several pieces of audio and images from Pixabay, which are used in the Application to serve a purpose (collectively, the "Stock Content"). We aim to comply with the Pixabay Terms of Service. This paragraph is a direct indication that we are not the creators of the Stock Content, however, as of the date of these Terms and Conditions, under the Pixabay Terms of Service we are granted the right to use and distribute the Stock Content taken from Pixabay for both non-commercial and commercial projects or in this case the Application. 

As of the date of these Terms and Conditions, the Pixabay Terms of Service announces that the uploaders of the Stock Content are solely responsible for the Stock Content they upload by warranting that they own all proprietary rights in the Stock Content they upload to the website.

You represent and warrant, that we are not legally liable for using any pieces of Stock Content from Pixabay, that may unknowingly be copyright infringement. To clarify, if a situation arises where there is a piece of Stock Content that is owned and / or licensed by you and is uploaded to Pixabay without your permission (which is then used by us in the Application), any legal issues must be resolved with the person or entity that has uploaded this Stock Content to Pixabay in the first place. We will however happily remove the said Stock Content from our Application within a reasonable time frame after you give us a notice by contacting us, as we take intellectual property rights very seriously.

The Content is provided on the Application “AS IS” for your personal use only. Unless specifically mentioned in these Terms and Conditions (The parts where we mention that we do not own the license to or be the owner of), no parts of the Application and no Content may be copied, distributed, sold, licensed, or exploited for any commercial purpose whatsoever, without our express prior written permission.

You are permitted to create, upload and share entertainment, gameplay, and review videos related to or featuring the Application for both non-commercial and commercial purposes, as long as you give credit to the Application (For example: by showing the name of the Application and / or providing a link to an official Application page) and don't wrongfully claim to be the owner / developer of the Application or claim to be the owner / representative / member of CampTeam Games.

Please note that the Application is intended to be downloaded exclusively from authorized sources. Unless expressly stated otherwise in these Terms and Conditions, obtaining the Application from any other source is considered a violation of these Terms and Conditions. CONTENT ADVISORY

The Application contains flashing lights and visual effects, that may not be suitable for individuals with photosensitive epilepsy or similar conditions.

The Application features blood, mild violence, and themes that some individuals may find frightening. Viewer discretion is advised when engaging with the Application and its contents.

THE APPLICATION IS PROVIDED ON AN AS-IS BASIS. YOU ACKNOWLEDGE AND AGREE THAT YOU TAKE FULL RESPONSIBILITY FOR YOUR USE OF THE APPLICATION.

TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE EXPLICITLY DISCLAIM ALL WARRANTIES IN ANY RELATION WITH THE APPLICATION AND YOUR USE OF THE APPLICATION, THIS INCLUDES, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO CIRCUMSTANCES OR EVENTS WILL WE WILL BE LIABLE TO YOU, ANY ENTITY OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT OR OTHER DAMAGES RELATED TO, IN CONNECTION TO OR ARISING FROM YOUR USE OF THE APPLICATION.
